Paternity Actions

Posted in Child Support

A paternity action, a court suit filed to have a man declared the father of a child, can be brought by either the mother or the father. Paternity actions are sometimes called establishment hearings, filiation hearings, or parentage actions.

Most paternity actions are initiated by welfare officials who provide TANF (Temporary Aid to Needy Families) to the mother and are required by law to seek reimbursement from the father. The mother must cooperate in these proceedings; failure to do so can result in a reduction or loss of her TANF grant.
Today, blood and DNA tests can affirmatively determine paternity with a 99.99% accuracy and can rule out paternity with 100% accuracy.
If paternity is established following a paternity action, the court will order the father to pay child support and grant him custody or visitation rights.

  • For the Love of A Child

My 20 yr old son was told 4 months ago that he was the father of what is now my 6 month old grandbaby. I have grown to love this child deeply as well as why husband and daughter. We kept her 19 days in Nov, 21 in Dec, and so far now about 10 in Jan. We have just found out recently that my granddaughter may not belong to my son. There were two others guys involved with her at the time the child was conceived. I am about to go crazy wanting to know the truth. But what hurts the most of all the time we have kept my grandchild and supported and loved her, the mother is now seeming to keep her away from us. The mother nor the father work. Nor is she on finacial aid. I myself can’t afford the fee for the DNA testing. Any advice on the best way to handle this would be greatly appreciated.
