Recent Case Discusses Contempt of Court Issues

The S.C. Court of Appeals recently affirmed a Family Court Order which awarded the wife alimony and attorney’s fees and found the husband in contempt of court.  The husband had failed to comply with the family court’s orders concerning the distribution of personal property, payment of wife’s equitable share of the marital home, harassment, and communication with wife about the children’s issues.  The Court of Appeals found that there was ample evidence to support the family court’s contempt findings on all four issues.  Also, it held that the family court had erred by referencing a sidebar conference in its final and modified final order, but noted that the erroneous mention of the sidebar did not amount to reversible error.  You can read the full text of Davis v. I recently wrote a letter to my children who are in custody of their father. I brought something about him from the past that the children already knew about but in retrospect realize I wrote it full of my pain of losing them. Now I am going back to court for contempt in SC. What can happen to me?

I received papers for comtempt of court for taking my child to have dental care that my ex-wife refused to do.She says she is the "PRIMARY CAREGIVER" and only she is allowed to make appointments for the child, and since she is required to by court to carry the insurance on the child , she says that she controls the medical issues of the child. We have joint custody of 183 days her, 182 me a year and all matters of the children needs to be discussed. She refuses to comply with the order and when I take care of the problem she want to yell "comtempt". Prior to last year I took care of all the medical , dental, and school matters of the children since the divorce.

I have been divorced since Sept.1995 and in the court papers my ex is suppost to have a life insurance policy of no less than 30,000.00 (10 for each child) to give to the children in the event of his death.His new wife has a policy on him for her, but does not include my 3 children. In the event that something happens,can I fight in court for the money for my children?
