Can You Lose Custody Because You Live With Your Boyfriend?

Question:  I have been told that since I am unmarried and live with my fiance', the Court will give custody of my child to her father who never sees her.  How can that be?

Answer:  First, you should be careful as to believing what "others" may tell you, as only your attorney can give you accurate advice specific to your particular case.  The things that your friends, co-workers, and/or family members may tell you (no matter how well intentioned they may be) may not necessarily be true or applicable to your case.

Now, if you are living with a boyfriend/finance' to whom you are not married, the Court will consider that to be an "immoral environment."  As such, it will be a factor, but it is only one of many factors that the Court will consider in a custody case.  In some cases it can be the determining factor, whereas in others it might not make as much of an impact on the outcome. 

The bottom line is that you should tell your attorney all of the facts of your case (both good and bad) so that he can then give you the appropriate advice.  Without knowing all of the facts of a particular case, it is virtually impossible to say how much of a factor any one item will or will not be (except for things such as child abuse or neglect).

Well I moved to South Carolina with my fiance for a better job than he could get up here in Pennsylvania.Me and him had a disagreement and I came back to pennsylvania now I want to move back to S.C and my x will not let me.I have physical custody witch was granted on my pfa that I had to take on on my childrens father since i came back to PA.he refuses to pay support threatens if i say i am filing now i recently filed for support in sc and he didn't show nor did i get there either and i have told there father that he could see the children on holidays and summer and school breaks i am not happy being up here.I really need to here from someone other than family and friends..Please help

hi i wanted to know i have been paying child support for my daughter and have asked the mom to let me spend time with her and she doesnt let me see her alone with my fiance she only lets me see her if i go to my mothers house and only i go. She wanted to take the child to another contry and i denied signing the papers to allow trip being that we have joint custody so she decided to take me to court and ask for full custody because i didnt sign the papers to let her take her and shes saying shell just tell the judge thta she doesnt want my fiance around my daughter can you really do that?
